This differentiates between those afk grinding using auto clickers and those who perhaps forget to press the attack button to chop a tree. Two completely different types of player, in my opinion.
As I think about this, there are really three types of players, I believe.

You have the auto clickers who are scum and can be treated as such. No argument on my end if the first-time punishment was increased.

As for AFK, Rule 13 really separates out plain old not paying attention from grinding with pets. When stating "playing AFK in this manner will result in punishment" it is referring to players who grind with pets (my emphasis). This is the one that would usually carry a level reduction.

The example of forgetting to press the attack button to chop a tree "has generally not been against the rules." Unless pets are involved, this isn't really an issue unless it gets to be "abusive" to other players.

I get the feeling that people are keeping this in mind and the discussions about "afk" are really geared towards the grinders with pets, but I feel it's important to keep in mind too.

AFK and autoclicking ALSO applies to chopping perpetual trees, mining and fishing in order to increase your "skill" levels.

Now while that should not bother a lot of players,
- if a level 20 Swordsman or dwarf (affinity 1.25), "auto-chop" in a clan area for 30-60-90 days straight, or
- a level 30 Dwarf auto-mines (affinity 1.50) for 30-60-90 days, or
- a level 30 Mage (affinity 1.25) auto-fishes for 30-60-90 days.

Can you imaging the skill level - a HUGE bonus to clans!

Just saying ... "auto-click" of any type should have the same punishment.

Pretty much, yes. Using a clicker to grind would result in a level deduction and jail. Using a clicker to chop/mine/fish/etc would result in the same level deduction and the same jail, AND have all skills reset to zero (use of the & character which is a symbol for "and" indicates in addition to and not instead of). I understand the spirit of your comment though, and regardless of type of use all would be punished under Rule 8.

[Edit: Second and third offenses are pretty indistinguishable as once a character is permanently jailed it doesn't matter much.]

The only difference I am getting to is between "afk without a clicker" issues:

1. AFK while grinding with pets. I get a good spawn going and leave my phone in my room while I go downstairs to grab a snack. A few minutes later I head upstairs and pick up my phone again. This is the type of AFK that "will result in punishment" under Rule 13. Sure, a warning appears to be customary the first time.

2. AFK without pets. I'm chopping or whatever while moving things to an alt. I finish with that and leave my character chopping while I go see whatever the kids are yelling about that particular minute. Eventually my character is just standing there doing nothing. This is the type of AFK that "has generally not been against the rules" under Rule 13.

That is my interpretation, that is, for whatever weight it holds. :)

The intent is what we are getting at here.

Auto clicking is intentional AFK, but other forms of AFK may be intentional eg. I've got a good spawn going so let pets keep killing while I do something else, or unintentional ...phone call...door bell...etc. Since mining and fishing without an auto clicker are timed by the game it will of its own stop if watching or AFK. In this case if an extended time the account will simply auto log out by the game design. So grinding AFK with or without a clicker is prolonged and punishable and mining or fishing only with a clicker ought to be considered AFK and subject to punishment.

Does the game not auto log when grinding without a clicker? Regardless of what the pets are doing, if the player does not interact with the game then I was under the impression that the 5 minute auto log feature applies.

It does still apply, yes. I just read Rule 13 as applying with or without a clicker. It would be easy enough to figure out though if you stop a spawn, get no response from a player, and they eventually log due to inaction.

I had that happen a few times when I had fairies. I'm a swordsman who couldn't kill many things much faster, so there were times I had a light spawn and was paying attention but not running around uselessly and... oops.

As one EX-GM told me. In that situation, open|close your bag on occasion.

It's enough to tell the server, "Hey you, Server ... Yea you, I AM HERE! OK!"

Only "a few" times because even some old dogs can learn new tricks. ;)

Thank you I didn't realize that 5 minute rule would apply to all inactivity. My characters always swing and my freya has fury so she likes to soften up the opposition....as if fairy pets need much help! I can't ever remember being autologged while grinding. :D Again thanks for clearing that up!
