What an interesting topic, collecting so different points of view!
I'd like to add a small contribution with a few thoughts.
Let's start with the meaning itself of the outlaw word - someone doesn't respecting rules. In game rules the word outlaw appears under chapter 9 only; this chapter refers to a general idea of reducing other players experience, and doesn't mention killing characters but as implicit in "(...) do anything else to annoy other players".
A first idea might be to explicitly stating rules about killing others in game rules page, so that players will know in advance what they are facing.
Outlaws often states they are such as the result of killing in friends defence and of testing pvp with friends (or so they claim!)
I don't know what might be do to create a difference among outlaw types in first case, but I believe the second one might be solved via the pvp invitation - as Ryaca described in his long reply here.
It might be shaped like that:
Player A sends player B a pvp offer - player B agrees, they fight and no one gets outlawed. In case player B refuses invitation and player A nevertheless attacks, outlaw status enters on stage.
This wouldn't change mechanichs for current pvp interaction, it just would add unpunished pvp testing among consenting players.
Another point mentioned by Ryaca is the one of players leaving FT due to being unexpectedly attacked during their first ingame hours.
We know a "pvp protection" is on sale in game real money shop; it's very possible that a new player wouldn't be likely to spend money on that in their first days in FT and might more probably leave. An idea might be to allow pvp only after a certain level - maybe... 20? - so to give new players time to settle in, familiarise with game mechanics and - also by witnessing others pvping - getting ready to be in the fight in case someone attacks them.

I really like all of the suggestions. Please keep them coming. I had a game administrator tell me that they think that no gear should drop in pvp and I agree with them 100%. I still strongly back the idea of no PVP if a player is not in a clan. I've seen a non clanned player participate in a clan war and not have to face retribution from opposing clan members. I believe this is 100% wrong and I would really like to see this changed. I believe it is an abuse of this game.

as my my opinion, i hate seeing black names...unless my friends(hahaha bias)
honestly, i want higher penalty for outlaw coz im not a fan of killings...my last game mmorpg i played, there is only 1 map(here in ft i suggest colesium and ofcourse clan map) where u can make pvp and all other maps are pvp disable...that game is pristontale...

I really like Blaze"s idea about bounty. I also really like Naomi's response. I am not a fan of attacking either. I only do it when others attack my fellow clan members. Ardesia's idea is really solid also. Corrupter's idea about drop rate percentage is pretty cool.

There's genuine PvP,, then there are griefers, who just pick on lower level characters repeatedly to steal their gear and reduce their XP. I have experienced this as a new player (level 5) and have been continually harassed all evening by a level 8 player who has somehow obtained a weapon that freezes me in place so he can attack me at will.
If nothing is done to prevent this, I'll quit.

Excellent point.
In this case, the guy probably has a batch of throwing daggers which do indeed freeze or stun you. Drop me a PM and we can meet up in game at some point and I'll give you some unfreeze potions.
If you hang about with people around your lvl you can fight him off as a group until he gets the message and leaves you alone.

This reason is exactly why I believe PvP should be limited to clans only. Here we have a new player in the FT community that doesn't even know the first thing about pvp, and they are being attacked by an experienced player that is probably using an alt to harass newer players. This does not welcome new players, it discourages them and turns them away from this game. Think of all the players that have felt this way and have quit out of frustration because this is the kind of treatment that they receive upon entering the world of FT. Before they get to experience and enjoy and learn about this great game, they are bullied and harassed. Something needs to be done about this type of behavior. At the very least, it is dispicable.

I played Parallel Kingdom for four years and didn't really do PvP. I was an assassin, using my skills to knock over monsters in large numbers
We did get people who harassed lower level players, but lower level players got protection from attack
Also even at higher levels, if one did not retaliate to the first blow, the attacker could di no further harm to you
Perhaps that's the best way forward
