If you have previously attacked the other player, then he can quite legitimately attack you.
If you are an outlaw, then ANY player can legitimately attack you, regardless of level.
If you are you are in a clan, then any player from a clan can legitimately attack you.
Have you read the game rules; particularly the section on pvp? You tick the box to say you've read them when you log in to the game.
