If it is that one, it is simply working like that: in order to buy a pet there, you have to own no other pets.

If you are high enough level (and have started some of the dog quests for the old man?) you can buy a war dog pet near bank after purchasing a shop pet. Just not the other way around.
Old soldiers never die, they just fade away.

And a perk if you have a "Private House".
But one pet from "The Pet Shop" take it home and put it in your house.
Go back to "The Pet Shop" and buy another.
You now have two pet shop pets.
